looks more than a procedural thing to me, the amendment is/was important as it means d.h.b. or anyone else could launch a new bid to purchase the port.

So Alex where are your plans to regenerate Dover going now that 'your' (although you now say it was KCC's) idea port tolls have been rejected.....

The 1991 Act amendment tabled by Charlie would have come too late for Dover had the Secretary of State approved the last proposal by the DHB. Politics is politics and the Amendment Bill was always politics (I think that the phrase is 'belt and braces'). Even had it been enacted prior to November 2011 (which it would have to have been in order to affect consideration of the latest DHB proposal) , the Amendment Bill would never have prevented the DHB from seeking privatisation, only required them to achieve a simple majority in favour of privatisation in a District referendum before the Secretary of State would consider their request favourably.
Now that the tide has turned and the Port of Dover will become a communitised asset (people's port) and, potentially, the template for the list of assets that the Govt (both this one and the last and most likely the next) wish to raise money from in order to reduce Govt indebtedness, the Amendment Bill has no political currency for now and is allowed to drop out under Parliamentary procedure and time rules.
Of far greater importance, as far as Dover is concerned, are the amendments to the Public Bodies Act which are already enshrined on the Statute Book.
It's a busy old world.

On past prediction, of course many expected the lib dems to re think where they have got themselves or risk total wipe out at the next election, they havn't and are now fighting an uphill battle against there own members and the public at large.

fair enough neil but i was of the opinion that the "public bodies" act only meant that a minister can choose whether or not to proceed with a sale.

The above is a very brief extract from the Act, which is nothing to do with privatisation of Trust ports. Ministers have all the power that they need to approve a sale under the 1991 Ports Act.
The Public Bodies Act grants powers to Ministers to create an order requiring bodies listed in Schedule 5 of the Act to transfer all their assets, functions, rights, duties, responsibilities and liabilities to an approved body or person as specified in schedule 1 of the Act. The DHB is listed in Schedule 5 and Industrial Provident Societies, Charities (of certain types) and others are listed in Schedule 1 of the Act. An order, once made, is subject to 24 weeks of Parliamentary Scrutiny and amendment before the final order can be enforced

that is exactly my point neil, the minister has the power but will he/she exercise it. one thing we can be sure of is that after the west coast rail franchise fiasco any decision will be made only after a lot of discussions with top civil servants and legal bods.
i think you are being very optimistic at this stage in thinking that mutualisation is on the cards.

Howard, much, much and vey much discussion has already happened. We are a very long way down the road.
As posted before, the first route that will be tried is the one of cooperation with what will be, by the end of May, essentially a new DHB. Only if the route to communitisation through cooperation with the revised DHB fails due to non-cooperation from DHB will the options provided to Ministers in legislation be utilised.
It's very odd, but pretty much everyone that I speak to outside of Dover who is involved in the Maritime Sector or Government is convinced that the Port of Dover will, one way or the other, be communitised and mostly they are more optimistic on the timescale that they believe it will happen in than am I.

i would love to know how the port is affected by the eastleigh by-election, must be the worst thread drift ever.
