They would be pretty foolish if they had not covered that after the West Coast fiasco.
My understanding that was precisely the reason for delay-whatever the decision.

I know of several parties who believe (and have been in receipt of advice) that approval for a sell off as proposed by DHB could be challenged on a number of grounds. We have to see what the decision actually is and what wording the Minister has used first in order to determine exactly what course of action will be taken and on what grounds.

I have no doubt they are suitably flush to cause the process to be put into question & have commercial interests to protect. I know of some also Neil, probably not the same as yours.

Paul, a pro-DHB sale decision would not be challenged on the grounds of not liking the decision.
From the beginning of 2010 to now, the law has changed with regards to communities.
Many people do not know the small-writing in the changed laws with regards to community participation in local decisions.
One thing is for sure, DHB do not have a majority of support among the people of Dover, and we still have not had a referendum on YES to Port privatisation or NO to port privatisation.
This is first and foremost a question of democratic will, I would suggest even similar to the CGI proposals.
Authority cannot just make decisions against the will of the Community and impose their own decision, in particular where Public Consultation comes into it.
I know that it's possible to get hundreds of signatures in a couple of hours on a topic which is of interest and concern to the local people. And there are some petitions on Port privatisation dating back to 2010.
However, a referendum would be necessary if the DfT should decide to go ahead with DHB privatisation.
And it can be either Yes or NO, with NO other party involved in the questions put over to the people.
If the answer is NO to the DHB bid, it cannot be presented again!
And I will take this one all the way down the road.
