For the first time The Sunday Telegraph can disclose how scores of people the Government wanted to remove from the country have been able to stay by claiming that they had a "family life" here under Article Eight of the European Convention of Human Rights.
A total of 102 people defeated the Home Secretary in the courts in 2010 on family rights grounds, including violent criminals and illegal immigrants who had no other right to be in the country.
None claimed that they would be in danger of torture or abuse if they were sent home.
It can also be disclosed that one foreign criminal who used Article Eight was a violent thug and drug dealer who beat his girlfriend and failed to pay child maintenance - but was still allowed to stay in a ruling made by three senior judges. Last night the figures fuelled the row over the use of the European Convention, which was passed into British law by the previous Labour government, and particularly Article Eight - the "right to private and family life". Dominic Raab, the Conservative MP who obtained the figures, said: "Before the Human Rights Act, no criminal had ever claimed a right to family life to frustrate a deportation order in this country.
"It is high time we changed the law, to restore some common sense and retain public confidence in our border controls."
The other family featured were the neighbours from hell who persisted in feeling victimised despite the 50+ complaints against them. The right to a family life is obviously important, as much for the rest of the family as for the applicant - but it must be balanced with the communities needs as well.

The question is, will the Government scrap this foreign law that Labour introduced, or just harp on about it and do nothing?
If "Big Society" meant hearing the public opinion, then surely Gov. would do something.
Again the question: is it all just talk?

of course it is all talk, no government cares what happens to people living at the sharp end.
the present lot will bemoan the "human rights act" knowing that they can deflect criticism from themselves by doing so.

Yes, the last line Howard quoted just about sums up how I feel.
Those who are ignoring or are on the wrong side of the law get away with a lot while those on the right side of the law seem to have their rights virtually ignored.
Thinking of Bern's example, the whole problem is that the Human Rights law comes across as family rights for some not others.

As we 've said on here many times, Human Rights, but also responsibilities - you can't beat your wife then claim the HR entitlement of a family life. You can't burgle someone's house then claim against them because you injured yourself while robbing them.
Too much weight on the criminal's side, not enough for the victim.

To start, i think the human rights act etc has some good stuff within it, and we need to taylor what we dio like before rippig it all up
This story from the torygraph is nothing than that tobe expeceted, its now to be seen if this cobbled together govt do anything to change things.
All to easy to blame the last govt, this cobbled together govt say they have 4 years so will they change things?
We have seen what k clarke feels on law and order he wants to free even more criminals, so this govt doing no more to change things.
In fact they are no longer seen as the party promoting law and order, they are seen as weak as the lib dems on law and order.
