I agree with the guys above..its very hard to see any victory here. I don't hink Charlie has got this right as people are losing or could lose jobs on a grand scale which is always immensely sad. We could also lose splendid ferries off the route and the company is doing well. I sincerely hope MyFeryLink can fight back. Here we have a couple of press releases to show for now. The Competition and Markets Authority (the UK regulatory body which has replaced the Competition Commission) has today issued its provisional decision that there have been no material changes in the market since its original decision in June 2013 which would serve to alter its original decision. As such, the CMA has provisionally confirmed its earlier decision that Eurotunnel should be prevented from operating ferry services from the port of Dover.
MyFerryLink cannot accept these conclusions, which run contrary to the clear statements of the Competition Appeal Tribunal in its judgment of 4 December last year. MyFerryLink continues to believe that the CMA does not have jurisdiction to review the transaction as a matter of UK merger law. Given the fundamental changes and growth in the market over the past 12 months, we are also surprised that the CMA has concluded there has been 'no material change' in market conditions since its previous report in June 2013.
We will continue to work with our legal advisors in challenging these provisional conclusions and in the meantime will continue, together with our dedicated employees, to focus on delivering the high quality service expected of our customers.
MyFerryLink is clear that it will exercise its legal right to return to the Competition Appeal Tribunal if the CMA maintains these preliminary conclusions in its final report.

Groupe Eurotunnel reacts to the CMA's preliminary decision to stop MyFerryLink's activity
Two years after the acquisition of 3 ferries and following the decision of the Appeal Tribunal, which rejected the original decision by the Competition Commission, Groupe Eurotunnel submitted to the Competition and Markets Authority (CMA) that a material change of market had occurred, based upon the 12% growth since SeaFrance ceased its operations.
Groupe Eurotunnel believes that, when stating that there has been no material change, the CMA simply seeks to justify the Competition Commission's original analysis, despite the change in the facts relating to the market: - Market growth has been far greater than the 2% predicted by CMA, - DFDS continues to operate successfully in the market, whereas the Competition Commission's original decision was based on the premise that DFDS would rapidly be forced to exit the market.
Groupe Eurotunnel believes that the CMA's preliminary decision is based upon an erroneous analysis of the significant changes in the cross Channel Ferry market since the Competition Commission's original findings relating to the market in 2012.
