    The legislation which limits the numbers of protestors and requires a ballot needs to be properly understood. The law does not absolutely require that. Firstly it only applies to trade unions and their members; secondly it only applies to disputes between employers and employees; thirdly, in return for placing obligations on strikers and their unions, it also confers certain legal immunities from prosecution or legal action in the civil courts.

    In this dispute there is no union; the protestors are not employees; and there is nothing to prevent the police arresting them for obstruction or for offences under the Public Order Act. The latter is also the case where strikes go ahead without a ballot or where there are mass pickets.
