  The Mercury keep insisting that he was jailed for being gay which is not true, under Morroccan law it is homosexual acts that are punished.

  He was not caught with his pants down so to speak , he was... "taken into custody after officials found a photo on his phone, believed to show some evidence of homosexuality"...

  You are right Howard, he knew the laws and decided to flout them, his choice to put his self in danger of arrest.
