09:4074629Could anyone on the Forum let me know about a query I have concerning anti-discrimination laws on the employment market in the UK? The question is: can a work-agency offer only British nationals to employers, or must they be from any nationality of people eligable to work in Britain?
Please supply an answer whoever has knowledge of this, as I have discovered something, and am not sure if it is in accordance with the law!

10:2874632I have come across an employment agency advertising in English for the UK that offers only Polish workers living in the UK, with the opportunity to recruit directly from Poland if the candidates avilable in Britain are not enough, and offering Polish nationals who are available to locate to the UK.
I think that the offer to find Polish nationals living in the UK - with obvious reference to the fact that the candidates are only Polish - is decisively against the anti-discrimination laws in our Country.
I made a copy of the offer which I downloaded from the Web, with the relevant contact numbers.
The offer of employment is in the UK, as this is obvious to discern from the add.

11:5174636Hi Alexander,
As an Agency we supply candidates in response to advertisements from our database of registered candidates for both Temporary and Permanent positions.
Candidates are selected to be put forward based on their skill sets and not by their nationality.
All candidates registered with us need to be eligible for work in the UK and we check all ID even the British so as not to discriminate against the non-British.
I would be happy to chat this over with you if you want to pop in to our office in the Market Square, it would be interesting to find out who and what this advertisement is about? was it local?

18:1174686The first agency seemed to be offering employment in Poland, but stated that it is practically impossible for foreign (non Polish) nationals to find work in Poland, unless sent there directly by a firm.
Another agency stated that there is a constant shortage of skilled labour in the West, and that Poland with 38 million people can supply all the silled labour necessary in all of the West.
One agency offered workers from Poland with a 100% satisfaction guarantee, stating that if the employed person leaves within 100 days, a replacement from Poland will be made available with equivalent skills.
The last one I looked at offered Polish workers resident in the UK, with the added offer to send workers directly from Poland who are ready to locate to Britain immediately. This agency states that the staff are all bilingual, speaking English and Polish.

19:3674705The agency didn't advertise whether the people offered for work speak English, only that they are from Poland, but that the staff of the agency speak English and Polish, and the reference is obvious: for UK employers to contact the agency-staff in English. Adding to that, I have come across vacancies in Kent as line-leader where to know Polish is preferable!
