What rights do i have as a consumer to take back a mobile phone i had brought from a shop in town ? it was a belated xmas gift from Mark the mobile of my dreams but only had it since weds last wk and ive had nothing but problems with it, the network signal is very poor to the point i cant ring out or take a call, cant txt or worse still as its a smart phone use it to its full capability which was one of the reasons i wanted it. the shop today said that a antenna of theirs was broken in 2010 and still hasnt been fixed which is why i cant use the phone does anyone know if i can take it back to the shop??

This will be the property of the service provider and not of the shop, I take it.
I have no particular expertise on the law here, but if it was me I would wonder if Mark had been sold something that lived up to the description, 'mobile phone'. I would take it back and demand a refund as the shop has surely sold something knowing that it would not (indeed could not) meet the users requirements.
If the shop then has a problem with the service provider because of their antenna fault...well that is a problem between they two.

not sure of the exact law mel but any item sold that does not serve the purpose it was meant for means that a full refund should be due.
not much of an excuse from the shop i would kick up a stink when other customers are in there if they refuse.

I'm with O2 and very happy with the reception/signal strength - never had a problem.

my latest one is also 02 reception very good but cannot get the web on it even though it is supposed to.

Also, if your neighbours enjoy good reception obviously the shop is toying with you.

Tom im well known for my quickness lol, im just a bit annoyed by it really , either it goes or i do what am i supposed to do when i go into labour carry flares with me around town

Clearly the shop are fobbing you off
The phone is not fit for purpose as you cannot make calls on it, which also suggests given others comments about O2 that the phone is faulty, they are obliged to replace it or fix it.

just dawned on me, when selling the phone they must have asked for your address and post code, that would have told them that the phone would be useless there.
