    as far as i can remember all new employees are taken on for a 3 month trial period, i would have thought that enough time to find out whether someone is up to the job.

    there is also the three warning letters that can be sent to someone not pulling their weight.

    from what i understand many cases go to tribunals who lap it all up, keeps them in work.

    if they were forced to turn away spurious claims then a lot of cases would not be heard and employers would have nothing to complain about.
