    No Alex. Under the Ports Act the government can a) order DHB to come up with a new proposal (s10) or b) come up with a scheme of its own (s12). Additionally the Public Bodies Act allows the Secretary of State the power to over-ride the Ports Act and deal with DHB as it wishes. So no new legislation is required, it's already in place.
